NO PURCHASE IS NECESSARY IN ORDER TO ENTER THE CONTEST OR BECOME ELIGIBLE TO WIN.

This Contest is sponsored byNUTELLA(Ferrero Canada Limited), (the “Sponsor”).
ELIGIBILITY
Contest is open to Parents, Grandparents, Aunts and Uncles of the nominated child who are residents of Canada and over the age of majority. Anyone wishing to nominate a child that does not fall within the above designation will be at the discretion of the sponsor. To be eligible to enter this contest, a person must, during the Contest Period, be a resident of Canada, have reached the age of majority in his/her Province/Territory of residence as of August 16, 2010 and must not be an employee of the Sponsor or their affiliated companies, employees or agents, their respective advertising or promotional agencies, the independent contest organization or a member of any such employee’s immediate family (regardless of where they live) or household (whether related to the employee or not). In these Contest Rules, “immediate family” includes mother, father, brothers, sisters, sons, daughters and/or spouse.THE CONTEST IS VOID WHERE PROHIBITED BY LAW, and is subject to all applicable Federal, Provincial and Municipal laws.
HOW TO ENTER
To enter, visit the website www.nutella.ca, find the “Great mornings, Great days” promo mention, complete the entry form, ensuring you complete all mandatory fields, including entry of the Jar Code from specially marked participatingNUTELLAproducts and click on “submit”. When completed and submitted, the entry will be recorded automatically. Only one (1) entry is allowed per person, per e-mail address, during the Contest Period. The specially marked participating products are -NUTELLA400 g,NUTELLA750 g andNUTELLA750 g (Bi- Pack).
Alternatively, you may enter once (1) by ordinary mail, pre-paid postage, by writing to “Nutella - Great mornings, Great days” Contest, 360 Dufferin St, Suite 103, Toronto, Ont. M6K 1Z8. Include your full name, address, phone number, and describe in 100 words or less how your child’s day is impacted by starting the day off right with a balance breakfast. Handwritten entries must be readily legible.
Limit of 1 entry per e-mail address, or by ordinary mail during the Contest Period; Monday August 16, 2010 12:00:00 p.m. to Sunday October 31, 2010 6:00:00 p.m. EST.
All entries (whether sent by ordinary mail or entered on-line) must be received before 6:00:00 p.m. EST, October 31. 2010. The contest starts Monday August 16, 2010 12:00:00 p.m. and ends at 6:00:00 p.m. EST Sunday October 31, 2010, the Contest Closing Date (the overall period being known as the “Contest Period”).

PRIZES
Grand Prizes
There are a total of three (3) Grand Prizes available to be won during the Contest Period. Each Grand Prize will consist of a $10,000 Registered Education Savings Plan (“RESP”). Each prize consists of a one time, upfront deposit of $10,000 made byNUTELLAinto an RESP established for the nominated child listed on the contest ballot. The child and the entrant on the ballot will be enrolled in the Plan as the beneficiary and subscriber respectively. The Prize is a group Registered Education Savings Plan (“RESP”). Deposits and the income earned on the deposits can be used to assist with the costs of a post-secondary education for the beneficiary. The final value of the RESP cannot be predicted or guaranteed as it will depend on several factors, including the amount of income earned in the RESP Plan and the amount of any administration fees deducted. The $10,000 deposit to the RESP Plan may be subject to a one time, upfront enrollment fee which will be deducted from the Grand Prize value. The number of units held in the winner’s RESP Plan may vary depending on the age of the child at the time of enrollment. All final details will be determined based on the final financial institution where the RESP is established. (Approximate Retail Value of each of the Grand Prizes is $10,000 CAD). The approximate retail value of the Prize is dependent on the associated fees of opening the RESP. The Prize is non-transferable and no substitutions are allowed except by the Sponsor who reserves the right to award a prize of equal or greater value if the advertised prize is unavailable. If a winner is unwilling or unable to accept any of the prizes in the contest as described in these rules, an alternate winner may be selected. The depiction of the prize in any advertising or promotional materials may not be identical to the one awarded to the Prize Winner. The Prize Winner is solely responsible for all expenses not specifically set forth herein. Any selected upgrades or additions to the Prize, must be invested at the Prize winner’s sole cost and expense. The Prize may not be transferred or assigned except by the Independent Contest Judging Organization or as otherwise indicated herein. Only the listed Prize will be awarded and no substitutions, cash equivalents or exemption will be made, it being understood and agreed, however, that the Sponsor reserves the right to substitute a different prize of equal or greater value if in the opinion of the Sponsor it becomes necessary. Other restrictions may apply. All provincial, federal and local taxes, fees not included are the responsibility of the Prize winner.
Secondary Prizing
There are a total of Eleven (11) Secondary Prizes available to be won during the contest period. Each Secondary Prize will consist of one (1) - $50 Staples gift card. The prize will include shipping of the gift card to the residence indicated on the contest entry form. Only the listed Prize will be awarded and no substitutions, cash equivalents or exemptions will be made, it being understood and agreed, however, that the Sponsor reserves the right to substitute a different prize of equal or greater value if in the opinion of the Sponsor it becomes necessary. Other restrictions may apply. All provincial, federal and local taxes not included are the responsibility of the Prize winner.
DRAWING
Grand Prize
On the Draw Date, the Sponsor will use electronic means to select, at random, three (3) Entries (each, a “Potential Grand Prize Winning Entry”), from among all eligible entries received online or by regular mail from qualified entrants. The Sponsor will also select, at random, up to six (6) Backup Entries (each, a “Backup Entry”) from the eligible entries received. The random selection to determine potential Grand Prize winners will be made by an independent contest judging organization in Toronto, Ontario on November 1, 2010 (the “Draw Date”) at approximately 3:00 p.m. (EST), from among all eligible online and regular mail entries received by the Contest Closing Date. The decisions of the contest judging organization in all matters related to the selection of winners in this contest, including without limitation the selection process to be employed, will be final. The selected Grand Prize contestants will be contacted by telephone at the telephone number indicated on his/her entry form. If a selected entrant cannot be reached after three attempts within 24 hrs of the draw, the Grand Prize will automatically be forfeited and an alternate Grand Prize winner will be selected. A Grand Prize contestant whose entry is so selected and contacted must, in order to become a winner, correctly answer, unaided, a mathematical skill-testing question, complete, sign and return the Declaration and Release form described below within 7 days from the time it was supplied to the winner, and comply with all of the other Contest rules. Failure to return the Declaration and Release form or correctly answer the skill-testing questions, in the time noted, will result in disqualification of the entrant and an alternate Grand Prize winner will be selected from the “Backup Entries”. This process will be repeated until all Grand Prize winners are declared. The skill-testing question will be administered on the Declaration & Release form.
Secondary Prizes
On the Draw Dates, the Sponsor will use electronic means to select, at random, one (1) Entry (the “Potential Winning Entry”), from among all eligible entries received online or by regular mail from qualified entrants. The Sponsor will also select, at random, up to five (5) Backup Entries (each, a “Backup Entry”) from the eligible entries received. The random selection to determine potential Secondary Prize winners will be made by an independent contest judging organization in Toronto, Ontario every Monday (with the exception of the contest starting date, or in the event the Monday falls on a statutory holiday, in which case the draw will take place on the following Tuesday) for the duration of the Contest Period with the final draw being made on Monday November 1, 2010 (the “Draw Dates”) at approximately 3:00 p.m. (EST), from among all eligible online and regular mail entries received by the Contest Closing Date for that week. The decisions of the contest judging organization in all matters related to the selection of winners in this contest, including without limitation the selection process to be employed, will be final. The selected contestants will be contacted by email at the email address indicated on his/her entry form. If a selected entrant does not confirm receipt of the email within 3 days of the draw, the Secondary Prize will automatically be forfeited and an alternate Secondary Prize winner will be selected. A contestant whose entry is so selected and contacted must, in order to become a winner, correctly answer, unaided, a mathematical skill-testing question, complete, sign and return the Declaration and Release form described below within 3 days from the time it was supplied, and comply with all of the other Contest rules. Failure to return the Declaration and Release form or correctly answer the skill-testing question, in the time noted, will result in disqualification of the entrant and an alternate Secondary Prize winner will be selected from the “Backup Entries”. This process will be repeated until all Prize winners are declared. The skill-testing question will be administered on the Declaration & Release form.
Please allow 4 - 6 weeks from the date of being declared a winner for the delivery of your prize.
Odds of being selected as either a Grand Prize or Secondary Prize winner depends on the total number of eligible entries received online and by regular mail by the Contest Closing Date.
LIMITS OF RESPONSIBILITY:
By accepting a Prize, each winner acknowledges that the Sponsor (and Independent Contest Judging Organization) are not liable to him/her or to his/her heirs and assigns for death, personal injury, property damage, or any other loss that may occur: 1) due to any act or omission of the Sponsor or Independent Contest Judging Organization with respect to the prize, or of any part or parts thereof, or 2) by reason of any other event over which the Sponsor or the Independent Contest Judging Organization have no control.
GENERAL
By entering this contest, contestants agree to abide by these Contest Rules and the decision of the Sponsor with respect to all aspects of the contest, which is final.
- Winners of the Super Soccer Weekend will be required to complete and return a Declaration and Release form prior to receiving the prize. All winners, and winners traveling companions, must sign the Sponsors Declaration and Release form confirming compliance, which includes agreement that he/she;
- In the case of the winner, is the authorized account holder of the e-mail address (if applicable) associated with the selected entry, was the person who submitted the selected entry, was eligible to enter the Contest and has complied with all of the Contest Rules; and
- accepts the prize as awarded, without substitution, and releases the Sponsor and/or their affiliated, associated and related companies, advertising, promotional agencies, the independent Contest Judging Organization and their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns from any liability in connection with the prize, or any use of the prize or this contest, as set forth in the Declaration and Release form.
- In the case of traveling companions, releases the Sponsor and/or their affiliated, associated and related companies, advertising, promotional agencies, the independent Contest Judging Organization and their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns from any liability in connection with the prize, or any use of the prize or this contest, as set forth in the Declaration and Release form.
- By entering this contest, each prize winner consents to the use of his/her name, address (city and province), and likeness without further remuneration, in connection with any publicity carried out by or on behalf of the Sponsor.
- The Sponsor will not be responsible for late, lost, illegible, incomplete or destroyed entries. The Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical errors, printing errors, lost, delayed or garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone lines. Entry material/data that have been tampered with or altered are void.
- The Sponsor reserves the right, in its sole discretion, subject to approval of the Régie des alcools, des courses et des jeux in Quebec, to cancel or suspend this contest should a virus, bug, printing error or other cause beyond the reasonable control of the Sponsor corrupt the security or proper administration of the contest. Sponsor reserves the right, subject to the approval of the Regie des alcools, des courses et des jeux ("Régie"), to terminate this contest or to amend these contest rules at any time without notice if any factor interferes with the proper conduct of the contest as contemplated by these Rules. The Sponsor may modify, clarify and/or amend these Rules & Regulations at any time by posting notice to that effect on www.nutella.ca.
- The Sponsor is not liable for any problems, errors, or negligence that may arise or occur in connection with the contest, including but not limited to any damage to an entrant’s computer system, software or any combination thereof, as a result of the entrant’s participation in this contest.
- All entries become the property of the Sponsor and none will be returned. No correspondence or communication will be entered into except, possibly, with the selected entrants. This contest is subject to all applicable federal, provincial and municipal laws. The contest and the contest rules shall be exclusively governed by and construed in accordance with the laws of Canada and the winner’s province of residence.
- Persons tampering with or abusing any entry mechanisms or policies will be disqualified. All entries in this contest will be automatically disqualified without notice or recourse if an entrant promotes this contest through unsolicited commercial e-mail or multiple postings.
- QUEBEC RESIDENTS: Any litigation respecting the conduct or the organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement. By submitting an entry, that entrant agrees to the contest rules including all conditions stated therein. The Sponsor and those associated with the Sponsor will bear no legal liability, expressed or implied, regarding the use of winning Submissions by the Sponsor and THE SPONSOR SHALL BE HELD HARMLESS BY A WINNER IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT THE WINNER HAS DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THE CONTEST RULES.
- We respect your privacy. All information collected is for contest and research purposes only unless otherwise specified and will remain the property of the Sponsor. No e-mail addresses or personal information collected will be shared, in any way, with any other parties.
